Terms of Service
These Terms of Service (“Terms”) govern use of the Benny Survives Factory application (“the App”), a TikTok developer app used to automate posting of short-form videos for the Benny Survives entertainment channel.
1. Acceptance
By authorizing or using the App with a TikTok account, you agree to these Terms and to TikTok’s own Platform Terms of Service and Developer Terms. If you do not agree, do not authorize or use the App.
2. Description of the App
The App helps channel operators generate and publish Shorts and related captions to TikTok for Benny Survives. It is an internal publishing tool, not a marketplace, social network, or general-purpose consumer service.
3. Eligibility and accounts
You must have authority to connect the TikTok account you authorize. You are responsible for safeguarding OAuth credentials and for activity performed through the App while it is authorized on your account.
4. Acceptable use
You agree not to use the App to:
- Violate TikTok rules, applicable law, or third-party rights
- Upload illegal, infringing, hateful, or deceptive content
- Attempt to bypass TikTok rate limits, security, or review processes
- Resell or redistribute App access without permission from the operators
5. Content ownership
Content published through the App remains owned by its respective rights holders (typically the Benny Survives channel operators). TikTok’s license to content you publish is governed by TikTok’s terms, not these Terms.
6. Availability
The App is provided on an “as is” and “as available” basis. Publishing may fail due to API changes, quota limits, network issues, or platform policy enforcement. We do not guarantee uninterrupted service.
7. Disclaimers
To the fullest extent permitted by law, the operators disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. TikTok remains a third-party platform; we are not responsible for TikTok’s decisions regarding accounts, visibility, or content removal.
8. Limitation of liability
To the fullest extent permitted by law, the operators of Benny Survives Factory are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from use of the App or inability to publish.
9. Termination
You may stop using the App and revoke TikTok authorization at any time. We may suspend or discontinue the App, including if required by TikTok or by law.
10. Changes
We may update these Terms by posting a revised version at this URL with an updated effective date. Continued authorization or use after changes constitutes acceptance of the revised Terms.
